The Demise of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the crisis sparked by the introduction of a new comprehensive peace framework for resolving the conflict appeared – temporarily – to have been stabilised. A Washington representative spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its countermove: an extensive attack of rocket attacks on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of conflicting incidents captured the grim essence of the outgoing year. By day, negotiation efforts are fought: optimistic declarations are delivered from multiple capitals. Immense energy is devoted on managing certain initiatives. By night, Moscow forcefully demonstrates the world that, for them, conflict continues to be the primary tool for achieving "resolution".

Nighttime Reality

As military strikes progressed into the early hours of Tuesday, the present situation of Ukraine's vulnerability was revealed. Ukraine is equipped to monitor projectile deployments from Russian territory, a capacity provided through up-to-date information. From observation points, defense planes that had been scrambled to counter approaching aerial threats flew past – advanced fighter aircraft provided to Ukraine by European allies.

Moments later, Kyiv's air-defence systems engaged: multiple launches targeted at a Russian ballistic missile. This was a modern interception technology at work, presumably delivered by partner states. Every deployment jolts you unexpectedly, causing tremors. The brief panic quickly becomes sober acceptance: perhaps the approaching threat won't strike its target this time, sparing the city from devastation and additional electricity failures.

Persistent Threats

Not long after, a heavy machine gun engaged a aerial vehicle somewhere nearby, part of a rapid response unit – probably Western-made equipment. Unfortunately, the projectiles didn't strike the opposing UAV – it maintained course toward its target.

Intermittently, this carried on until dawn. Kyiv greeted the daybreak reports: seven people killed, destruction and utility failures in many homes as a result of the evening attack. As always, everyone still went about their day – enduring hostilities. But those 24 hours demonstrated Ukraine's vital need on external assistance – a need that European nations are evidently unprepared to replace in the short term.

Failed Diplomacy

The comprehensive proposal from Washington sparked intense emotion, debate and profound anxiety – and briefly redirected concern from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after earlier high-level meetings and international summits.

Every new approach from Washington follows the identical sequence: a political offensive against Ukraine, which Kyiv, with other European capitals, effectively counters. They contain the crisis but never actually achieve victory. This trend will, no doubt, endure.

Strategic Calculations

It is convenient to criticize specific actors of repeatedly advocating Moscow's conditions. But that does not seem to be the complete picture. American leadership functions according to a principle understood by experienced diplomats: you cannot win at the negotiating table what you have lost on the battlefield. The American government assumes that it is unrealistic to force Russia to abandon the areas that it currently occupies in Ukraine's southern or eastern regions.

The issue is that while acknowledging this situation, US leadership does nothing to deter Moscow, through statements or actions, from assuming that the current condition will not shift further in its advantage in the near future.

Opposing Positions

Therefore, Moscow is certain that the clock favors them – that Ukraine and its supporters are coming close to fatigue. Their motivation to agree to terms that does not give them the largest achievable advantage is virtually nonexistent. There may be numerous efforts to stop fighting, but they will carry on as long as Russia's government remains supremely confident in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still endure, progressively conceding lives and land but averting a complete military breakdown until situations evolve in its advantage.

Existing Situation

Factually, there are no actual prerequisites for a armistice. Now, personal considerations are becoming relevant: personal goals to mediate resolution and achieve global acclaim, and Ukrainian leadership's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the country's interests against any initiative Kyiv finds unsuitable, so that their priority does not move to internal issues. And although their mission will now be significantly challenging after recent developments, it remains very improbable that this will alter their fundamental strategy.

These conflicting dynamics are driving the talks.

Conclusion and Outlook

It took a only one week to kill the proposed articles of the most recent proposal. Forceful and unpredictable management of the matter by Washington, pushback by Ukraine and the remaining European nations, along with pacifying measures of negotiators, and finally, current information leaks, all served their function.

While new initiatives based on previous concepts are imminent, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are founded on Moscow's terms and reflect particular unwillingness to alter the situation, if they stand together and strengthen their defence capabilities at a much faster pace. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the coming months, mainly require continued Western support.
